How We Collect and Use Your Personal Information
To provide the Services, we collect and have collected over the past 12 months personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.

What Personal Information We Collect

Information We Collect Directly from You

- Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you.
- When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

How We Use Your Personal Information
- Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.
- Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites. If you are an EEA resident, the legal basis for these data processing activities is our legitimate interest in selling our products, according to Art. 6 (1) (f) GDPR.
- Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately. If you are an EEA resident, the legal basis for these data processing activities is our legitimate interest in keeping our website secure for you and other customers, according to Art. 6 (1) (f) GDPR.
- Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you according to Art. 6 (1) (f) GDPR.
Cookies
Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites.
Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.
Our website also recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will treat such signal as a valid request to opt out of sharing / targeted advertising for the associated browser or device, and, if we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well. Other than the Global Privacy Control, we do not recognize other “Do Not Track” signals that may be sent from your web browser or device.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for contract fulfillment purposes, legitimate purposes and other reasons subject to this Privacy Policy. Such circumstances may include:
- With vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).

Children's Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Your Rights

If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

If you are not satisfied with our response to your complaint, depending on where you live you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. International Users
Please note that we may transfer, store and process your personal information outside the country you live in. Your personal information is also processed by staff and third party service providers and partners in these countries.
If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
SMS / MMS TEXT MESSAGE MARKETING PROGRAM PRIVACY POLICY
Your privacy is extremely important to us. We will only use the information you provide through the Program to transmit your mobile messages and respond to you, if necessary. This includes but is not limited to, sharing information with platform providers, phone companies (carriers), and other vendors who assist us in the delivery of mobile messages.
WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY.
Nonetheless, We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us with information in connection with the program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to the program and pursue any appropriate legal remedies.
California Civil Code Section 1798.83 and The General Data Protection Regulation 2016/679 (GDPR) allow users of the program who are California or European Union residents to request certain information regarding our disclosure of the information you provide through the Program to third parties for their direct marketing purposes.

Tracking Technologies and the Third Parties We Work With
This section names the categories of partners that receive personal information from us or through our Site, so that you can make informed choices. The specific providers may change; the list below is current as of the date above.
- Platform and payments. Shopify hosts our store, provides checkout and Shop Pay, sends order and shipping confirmations, and processes payments through Shopify Payments. If you pay with PayPal or Klarna, you provide your details directly to them in their checkout, and they act as independent controllers of that data under their own privacy policies.
- Fulfillment and shipping. Warehouses and carriers that pack and deliver your orders receive your name, delivery address, phone number and order contents.
- Email and text messaging. Klaviyo sends our marketing emails and text messages and some order-related messages, and stores your contact details, order history and how you interact with our messages.
- Subscriptions. Loop Subscriptions runs the subscription portal, stores your subscription and renewal details, and charges renewals through Shopify.
- Reviews. Yotpo collects and displays product reviews and stores the name, email address and content you submit with a review.
- Advertising and measurement. Meta Platforms, Inc. (Facebook and Instagram Pixel and Conversions API), Google LLC (Google Tag Manager, which may load Google Analytics and Google Ads tags), Hyros and Triple Whale receive information about your visit and purchases so that we can measure advertising, build advertising audiences and show you relevant advertisements on other sites and apps. This can include the pages and products you view, items you add to your cart, purchases and order value, your device and browser identifiers, your IP address, and hashed (scrambled) versions of your email address or phone number used to match you to an advertising account you already hold with that platform.
- Affiliate tracking. Everflow records when you arrive from an affiliate or partner link so that the partner can be paid. Partners are paid on the basis of the click identifier and order value.
- Site testing and session replay. Elevate runs A/B tests and may load Microsoft Clarity, which records how visitors interact with pages, including mouse movements, clicks, scrolling and typing in fields that are not marked as sensitive. Payment fields and passwords are never recorded. We use these recordings to fix usability problems. Microsoft may also use Clarity data to improve its own services under its terms, so we treat Microsoft as a third party for consent purposes.
- Customer support tools. Help desk, email and telephone systems store your messages and call notes. Calls may be recorded for training and quality where you are told so at the start of the call.
How to control tracking. You can opt out of the sharing of your information with advertising partners at any time on our Your Privacy Choices page, linked in the footer of the Site; through the Global Privacy Control signal in your browser, which we treat as an opt-out of sale, sharing and targeted advertising for that browser; and through the advertising settings offered by Meta and Google and the opt-out tools of the Network Advertising Initiative and Digital Advertising Alliance. Blocking cookies in your browser also works but may break parts of the Site.
Notice at Collection and Additional Disclosures for California Residents
This section applies to California residents and is provided under the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the "CCPA").
Categories of personal information we collect, and why. The table in "How We Disclose Personal Information" above lists the categories we have collected and disclosed in the preceding 12 months. For each category, the sources are you, your device, and our service providers; the business purposes are those listed in "How We Use Your Personal Information" above; and the retention period is set out in "How Long We Keep Personal Information" below. We collect the following categories of sensitive personal information: account log-in credentials, payment card details (collected and stored by our payment processors on our behalf), and health-related information that you choose to give us, for example in a quiz, survey, review or support message. We use sensitive personal information only to provide the products and services you request, to maintain security, and for the other purposes permitted by the CCPA, and we do not use it to infer characteristics about you. For that reason the right to limit the use of sensitive personal information does not currently apply, but you may still ask us to delete it. Records of the wellness products you view and buy are not sensitive personal information under the CCPA, but they may be consumer health data under other state laws; see "Consumer Health Data" below.
Sale and sharing. We do not sell personal information for money. We do "share" personal information for cross-context behavioral advertising, as the CCPA defines it, by allowing advertising platforms to collect identifiers, internet activity and commercial information through cookies and pixels on the Site, and by providing hashed contact details to match you to advertising audiences. We do not knowingly sell or share the personal information of consumers under 16 years of age.
Do Not Sell or Share My Personal Information. You can opt out of sharing by clicking the "Do Not Sell or Share My Personal Information" link in the footer of the Site, which opens our Your Privacy Choices page, by enabling the Global Privacy Control signal in your browser, or by emailing support@gentlepatches.com with the subject line "Do Not Sell or Share". Opting out through the page or a browser signal applies to the browser and device you are using; if we can associate that browser with your account, we also apply it to your account. Emailing us applies the opt-out to your account and the contact details on it.
Notice of financial incentive. From time to time we offer a discount, for example a percentage off your first order, in exchange for subscribing to our email or text messages. The personal information involved is your email address or mobile number and, over time, your interaction with our messages and your purchases. You opt in by submitting the sign-up form and can withdraw at any time by unsubscribing or replying STOP, after which we stop sending messages but you keep any discount you already used. We estimate that the value of the personal information to us is reasonably equal to the value of the discount, based on the expense of providing it and the revenue we expect from the resulting messages.
Your rights. You have the right to know what personal information we collect, use, disclose, sell and share; to access it and receive a portable copy; to correct inaccurate personal information; to delete personal information, subject to exceptions; to opt out of sale and sharing; and not to be discriminated against for exercising these rights. To exercise them, email support@gentlepatches.com with the subject line "Privacy Request" or write to the address at the end of the Privacy Policy. We will confirm receipt within 10 business days and respond within 45 days, and we will tell you if we need up to 45 more days. We will verify your identity by matching the details you give us against the details on your order or account, and we may ask for more information if the request concerns sensitive personal information or deletion. An authorized agent may submit a request for you if the agent provides your signed permission and we can verify your identity, or if the agent holds a power of attorney.
Shine the Light. Under California Civil Code Section 1798.83, California residents may request once a year a list of the third parties to which we disclosed personal information for their own direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.
Additional Disclosures for Residents of Other U.S. States
If you live in Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah or Virginia, or in another state with a comprehensive consumer privacy law, you may have the right to confirm whether we process your personal data and to access it; to correct inaccuracies; to delete personal data; to obtain a portable copy; and to opt out of the processing of your personal data for targeted advertising, for sale, or for profiling in furtherance of decisions that produce legal or similarly significant effects. We do not profile you for such decisions. We treat the Global Privacy Control, and any other signal that your state's regulator has recognized as a universal opt-out mechanism, as an opt-out of targeted advertising and sale where the law of your state requires it. Where your state requires consent before we process sensitive data, including health-related information you give us, we ask for that consent at the point of collection. We do not sell sensitive data.
To exercise your rights, email support@gentlepatches.com with the subject line "Privacy Request". We respond within 45 days and may extend once by 45 days where reasonably necessary, telling you why. Appeals. If we decline your request, you may appeal within 60 days by replying to our decision or emailing us with the subject line "Privacy Appeal". We will respond in writing within 45 days with the reasons for our decision. If we deny your appeal, you may contact your state attorney general or other privacy regulator.
Consumer Health Data
Because some of our products relate to health goals such as weight management, metabolic support and stress, records of what you buy and view on the Site can be "consumer health data" under the Washington My Health My Data Act, Nevada Senate Bill 370 and the Connecticut Data Privacy Act. Our separate Consumer Health Data Privacy Policy explains what consumer health data we collect, why, who we share it with, and how residents of those states can access it, withdraw consent or have it deleted. Where those laws apply, we share consumer health data with advertising platforms only with your consent, which you give through a specific consent request on our Site that names the health-related data involved, separately from your consent to our collecting it, and which you can withdraw at any time on the Your Privacy Choices page.
How Long We Keep Personal Information
- Order, payment and invoice records. 10 years after the order, as required by Lithuanian accounting and tax law. Order-level advertising attribution records are kept with the order records.
- Account information. For as long as your account is open, and up to 3 years after your last order if you do not close it.
- Subscription records. For the life of the subscription and 10 years after the last renewal, as part of the order records.
- Customer support messages and call notes. 3 years after the last interaction, or longer where needed to establish, exercise or defend a legal claim.
- Marketing contact details. Until you unsubscribe or opt out, or after 3 years without any interaction with us.
- Consent and opt-out records. We keep a record of your consent to receive text messages for 5 years after the last message we sent you, and a record of your opt-out indefinitely so that we do not contact you again.
- Website analytics and advertising data. Up to 24 months from collection in analytics tools, unless you withdraw consent sooner.
- Session recordings. Up to 30 days.
- Reviews. For as long as the product is sold and 2 years after, unless you ask us to remove your review sooner.
When a retention period ends we delete the data or anonymize it so that it can no longer be linked to you.
Clarification of the SMS Program Privacy Statements
The SMS program statements above say that we do not sell or transfer for profit phone numbers collected through the Program. That remains true: we do not sell phone numbers and receive no money for them. Phone numbers collected through the Program are disclosed to the vendors that deliver our messages and, unless you opt out under "Do Not Sell or Share My Personal Information" above, may also be sent in hashed (scrambled) form to Meta and Google to match you to an advertising account you already hold with them. California law treats that matching as "sharing" even though no money changes hands, which is why this Privacy Policy says we have "shared" identifiers. If you opt out, we stop using your phone number and email address for audience matching.
Your Privacy Choices at a Glance
- Marketing emails. Use the unsubscribe link in any email, or email support@gentlepatches.com.
- Marketing text messages. Reply STOP, or use any other reasonable means, including replying QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE or OPT OUT, emailing us, or telling our support team.

- Phone calls. If we call you about an order and you do not wish to receive further calls, tell us during the call or email us. We do not make marketing calls to numbers on the U.S. National Do Not Call Registry except where you have given us express consent.
Security and Breach Notification
We protect personal information with administrative, technical and physical safeguards appropriate to its sensitivity, including encryption of data in transit, access controls, staff access on a need-to-know basis, and contractual security obligations for our service providers. Payment card details are handled by our payment processors and are not stored by us. If a security incident affects your personal information in a way that the law requires us to report, we will notify you and the relevant authorities without undue delay and within the time the law sets.
Automated Processing and Artificial Intelligence
We may use automated tools, including artificial intelligence, to recommend products, to personalize the Site and our messages, to detect fraud, and to help our support team draft replies. A person reviews any decision that would significantly affect you, such as refusing an order for suspected fraud, before it is final. We do not use automated decision-making that produces legal or similarly significant effects on you without human involvement.
Data Controller and Regulators
Prolong Lab, UAB, Dominikonų g. 11-101, LT-01131 Vilnius, Lithuania, trading as Gentle Patches, is the controller of your personal information.
